ATS Technology Pvt. Ltd. is a professional recruitment and hiring solutions provider offering manpower sourcing, screening, coordination, and placement services for companies ranging from startups to large enterprises.

Our services include but are not limited to:

  • Bulk hiring

  • Sales and marketing staffing

  • Delivery and logistics staffing

  • BFSI, customer service, and office-based recruitment

  • Startup hiring support

  • Remote and field-based manpower deployment


3. Acceptance of Terms

By using our services or submitting any request (online, offline, via email, or verbally), you:

  • Agree to comply with and be bound by these Terms & Conditions

  • Confirm that you are authorized to represent the company or business you act on behalf of

  • Accept the privacy, refund, cancellation, and shipping policies published by ATS

4. Service Engagement

Once you raise a hiring request or initiate a recruitment campaign with ATS:

  • A dedicated recruiter or team is assigned

  • The service scope, timeline, and pricing are mutually defined

  • Service is considered “activated” once resource allocation begins

  • All instructions and updates must be provided clearly and promptly by the client

ATS reserves the right to reject or cancel any project that involves unethical practices, misleading information, or misuse of candidate profiles.


5. Client Responsibilities

Clients engaging with ATS must:

  • Provide accurate job descriptions and company details

  • Inform us about hiring preferences, protocols, or restrictions in writing

  • Cooperate during the interview, selection, and onboarding process

  • Not misuse or share candidate data provided by ATS for unauthorized purposes

  • Make payments as per agreed timelines

Failure to fulfill these responsibilities may result in suspension or termination of services.


6. Candidate Data Usage

ATS collects and shares candidate data solely for the purpose of recruitment. Clients receiving this data:

  • Must use it only for the hiring purpose intended

  • Are prohibited from sharing it with third parties without consent

  • Must inform ATS of interview outcomes or hiring status

  • Are responsible for ensuring the safe handling of such data as per data protection laws

Misuse of candidate data will lead to legal and financial consequences.


7. Payment Terms

  • Payment models may vary: one-time, recurring, or stay-duration based

  • The agreed payment amount and method will be mentioned in the invoice or proposal

  • Invoices must be paid within the stipulated time

  • Delays in payment may lead to service suspension or legal recovery

  • GST and other applicable taxes will be charged as per Indian law


8. Refund & Cancellation

ATS follows a clear Refund and Cancellation Policy:

  • Refunds are only applicable in limited scenarios such as duplicate payment or service not initiated

  • Cancellations are subject to cancellation fees depending on the project status

  • No refunds are applicable once the candidate has been placed or joined the organization

9. Confidentiality

All client and candidate data, internal hiring protocols, and service-related communications are treated as confidential. ATS:

  • Does not disclose such information to third parties without permission

  • Reserves the right to retain general statistical hiring data for internal analysis

  • Uses secure systems to store and manage sensitive data


10. Intellectual Property

All content, designs, logos, and documentation provided by ATS (excluding client-provided materials) are the intellectual property of ATS Technology Pvt. Ltd. Unauthorized copying, reproduction, or distribution is strictly prohibited.


11. Service Limitations

While we strive to provide excellent and timely recruitment services, ATS does not guarantee:

  • Selection or joining of every candidate sent

  • Specific performance of hired employees

  • Hiring outcomes beyond our scope of screening and recommendations

Recruitment involves human decisions and external variables, and thus outcomes may vary.


12. Termination of Services

ATS reserves the right to terminate a service engagement at any point in time if:

  • The client fails to comply with payment or communication terms

  • There is suspected misuse of our services or candidate data

  • There is harassment, misconduct, or non-cooperation by the client

In such cases, the client will be billed for work done up to the termination point.


13. Indemnification

Clients agree to indemnify, defend, and hold harmless ATS Technology Pvt. Ltd., its employees, directors, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:

  • Breach of these Terms

  • Misuse of candidate information

  • Delayed or wrongful payments

  • Any damage resulting from hiring or employment decisions made by the client


14. Dispute Resolution

In the event of a dispute between the client and ATS:

  • Both parties shall first attempt an informal resolution through discussion

  • If unresolved, the matter will be referred to arbitration under Indian Arbitration Law

  • The legal jurisdiction will be Jaipur, Rajasthan, India


15. Force Majeure

ATS is not liable for delays or disruptions caused by conditions beyond our control, such as natural disasters, strikes, pandemics, internet outages, or governmental actions.


16. Policy Updates

ATS Technology Pvt. Ltd. reserves the right to update or change these Terms & Conditions at any time. Changes will be posted on our website and apply to all future transactions and ongoing engagements.


17. Governing Law

This agreement and any disputes arising from it shall be governed by the laws of India, with Jaipur, Rajasthan as the sole jurisdiction.
